Because home values here are high, the difference between the loan balance and the auction price is frequently large, and second mortgages, HELOCs, and HOA liens compete for it. Unlawful detainer cases are heard at the justice center that serves the property. The response deadline is 10 court days from service of the summons, statewide. Most Orange County tenancies of a year or more are covered by the Tenant Protection Act’s just-cause and relocation rules, and a handful of cities add local requirements. Former owners still living in a foreclosed home are entitled to a 3-day notice to quit before any lawsuit, and bona fide tenants in a foreclosed property are entitled to 90 days.
